Merchant Compliance Updates
The email below outlines non-compliant merchants that Esquire has shopped and the process for new submissions to CBCAL and Esquire moving forward to ensure compliance.
- For existing merchants that you have been notified as non-compliant, the merchant will have 7 days from today’s date to provide compliance photos.
- If proof of compliance is not received and the merchant is not compliant, the merchant will be switched to traditional pricing.
- Applications submitted to Esquire Bank are limited to Traditional and Surcharge only.
- Any new merchant boarded through CBCAL or Esquire will be boarded as traditional if their MCC is on the chart below.
- Should the merchant want to engage in surcharge in states where permitted, dual pricing, or cash discount, the merchant must provide all required compliance photos or had a site visitation deemed compliant; Merchant Industry will then transition the merchant to the selected program type.
- A percentage of your merchants will have a third party site inspection conducted, results will be shared with you at a portfolio level.
- Should a merchant be identified as not compliant, they will have 7 days to correct the identified issues before moving to traditional pricing on the backend.
- Any merchant identified by a card brand as not being compliant will be moved to traditional pricing until compliance proof is provided by the card brands and the case has been closed.
- Compliance proof mentioned in the chart below is required on the following MCC’s.
